This document outlines the warranty terms provided by Holland Mechanics BV, located in Purmerend, The Netherlands, (“Holland Mechanics”) for machines delivered, subject to the conditions detailed herein.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

1. Warranty Coverage<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Holland Mechanics warrants that the equipment comprising the aforementioned machines shall be free from defects in material and workmanship, when used under normal conditions and service, as specified below.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2. Duration of Warranty<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Claims under this guarantee may only be made by the initial user of the system, and must be submitted no later than twelve (12) months following the original delivery date of Holland Mechanics & Marchetti machines, as indicated. The delivery date is defined as the date when the machines are loaded onto a truck for road transportation, or subsequently for sea transport. When a Service Level Agreement is in effect, the warranty period will be extended to the specified duration, subject to the same conditions outlined in these warranty terms<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3. Conditions of Warranty<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Holland Mechanics’ obligation under this guarantee is expressly limited to the repair or replacement of a defective part or item of the machine. All other claims, whether statutory or otherwise, and any resulting damages, are hereby explicitly waived by the purchaser. Holland Mechanics may fulfill this obligation by either repairing the machine(s) or dispatching, F.O.B., a similar part for the replacement of the defective component. The purchaser must notify Holland Mechanics in writing within 30 days of discovering the defective part and return said part, freight prepaid, to Holland Mechanics. Holland Mechanics will assess the defective part and, at its sole discretion, determine whether it is indeed defective.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Expenses related to the travel, accommodation, and daily allowances for the service engineer from Holland Mechanics are not covered by this guarantee.\u00a0This guarantee does not extend to products manufactured by a third party, beyond any guarantee provided by said manufacturer to Holland Mechanics, provided such guarantee remains in effect at the time of enforcement.\u00a0<\/span>This guarantee does not apply to failures or damages resulting from neglect, inadequate maintenance, misuse, accidents, improper installations, modifications, or repairs to the equipment, or any other causes beyond the reasonable control of Holland Mechanics.<\/span>No distributor or representative of Holland Mechanics is authorized to bind Holland Mechanics to any guarantee beyond the terms outlined herein.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

This guarantee supersedes all other guarantees, whether express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose. In no event shall Holland Mechanics be liable for any consequential or incidental damages.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Extensions of the guarantee period, with or without a service level agreement do not imply an extension of the original guarantee duration. The guarantee period does not reset following the delivery of a spare part and\/or service visit conducted under the guarantee.<\/p>
